misrepresentation, defined:
a misstatement or omission of fact. A misrepresentation, however, is a thing of degrees. The law considers whether a misrepresentation was of an innocent or fraudulent nature. What was the intention of the party making the misrepresentation? Was it deliberate or not? The law also considers whether or not the misrepresentation was of a material nature. In other words, did a reliance on the misrepresentation induce another to act? If so, did that reliance lead to some harm? How these questions are answered will have real legal significance.
