mutuality of consideration, defined:

a principle of contracts that each party must get something of legal value from the bargain for there to be a contract. The mutuality of consideration distinguishes a contract from a gift. Compare mutuality of consideration to nominal consideration which designates consideration of insufficient legal value to justify a contract.
