An example of speculative damages:
Ralph is involved in a car accident and sues the driver of the other car seeking an award for damages. In addition to payment for damage to his vehicle and his medical bills, Ralph asks for an additional $1,000,000.00 in damages based on the claim that he will have nightmares for the rest of his life which will limit his ability to work. The court is likely to find the last claim without proof and dismiss it as a request for speculative damages.
